Please read these Terms of Service ("Terms") carefully before using the Monarca Clinic website or any of our services. By accessing our website or engaging our services, you agree to be bound by these Terms.

 

1. Definitions

• "Monarca Clinic" / "Monarca" / "we" / "us" / "our": Refers to Monarca Clinic, a patient coordination and concierge service. 

• "Services": Refers to the patient coordination, consultation scheduling, travel logistics, and follow-up services provided by Monarca Clinic.

• "User" / "you" / "your": Refers to any individual who accesses our website or engages our services.

• "Surgeon": Refers to any independent, board-certified physician featured on our website or to whom we refer patients.

• "Hospital" / "Partner Hospital": Refers to any independently owned and operated medical facility where procedures coordinated by Monarca Clinic are performed.

• "Procedure": Refers to any surgical or medical procedure coordinated through Monarca Clinic.

 

2. Nature of Our Services

Monarca Clinic is a patient coordination and concierge service. We are not a hospital, medical clinic, or healthcare provider. We do not employ surgeons or medical staff, we do not perform medical procedures, and we do not provide medical advice, diagnosis, or treatment.

Our services include:

• Facilitating introductions between patients and independent, board-certified surgeons.

• Scheduling initial coordinator calls and surgeon video consultations.

• Coordinating travel logistics, including airport transfers, hotel accommodations, and hospital transportation.

• Providing access to a patient portal for communication, document storage, and appointment management.

• Coordinating post-operative telehealth follow-up appointments.

All medical decisions, surgical procedures, and clinical care are the sole responsibility of the independent surgeon and hospital involved in your care. Monarca Clinic does not direct, supervise, or control any aspect of your medical treatment.

 

3. Eligibility

You must be at least 18 years of age to use our services. By using our website or engaging our services, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

4. Consultation Process and Fees

4.1 Initial Coordinator Call

The initial call with a Monarca coordinator is provided free of charge. During this call, you will discuss your procedure of interest, logistics, and any required pre-operative tests or clearances.

4.2 Surgeon Video Consultation

A private video consultation with your surgeon is available for a fee of $50 USD. This fee is non-refundable and covers the surgeon's time for evaluation and discussion of your goals, candidacy, and personalized treatment plan. The consultation fee does not guarantee that you will be deemed a candidate for any procedure.

4.3 Coordination Fee

Monarca Clinic charges a coordination fee for its services. The coordination fee and what it includes will be disclosed to you in writing before you commit to any procedure. The coordination fee is separate from the surgeon's fee, hospital fees, and any other costs associated with your procedure.

5. Pricing, Payment, and Refunds

5.1 Pricing

All Monarca Clinic fees and procedure quotes are provided in US dollars (USD). Prices displayed on the website are estimates and are subject to change. You will receive a detailed, itemized quote after your surgeon consultation. The quote will specify what is and is not included.

Included in a standard quote: surgeon's fee, anesthesiologist fee, hospital facility and operating room fee, standard post-operative medications during your hospital stay, follow-up video consultations, and ground transportation (airport-hotel-hospital transfers).

Typically not included: international airfare, hotel accommodation, pre-operative lab work performed in the US, and any non-standard implants, materials, or medications.

5.2 Deposit

A deposit of 10% of the total procedure cost is required to confirm your scheduling. The deposit is applied toward your total balance.

5.3 Payment

Full payment of the remaining balance is due before or on the day of surgery. We accept wire transfers and major credit cards. Financing plans may be available; ask your coordinator for details.

5.4 Cancellation and Refund Policy

Cancellation policies are as follows:

• Cancellation more than 30 days before the scheduled procedure: Full refund of the deposit, minus a $100 USD administrative processing fee.

• Cancellation 15 to 30 days before the scheduled procedure: 50% of the deposit is refunded.

• Cancellation less than 15 days before the scheduled procedure: The deposit is non-refundable.

• No-show: No refund.

• Cancellation by the surgeon or hospital: Full refund of all payments, including the deposit. Monarca Clinic will work with you to reschedule with the same or a different surgeon at no additional coordination cost.

• Medical ineligibility: If your surgeon determines during the pre-operative evaluation that you are not a candidate for the procedure, all payments will be refunded in full, minus the $50 consultation fee.

6. Travel and Logistics

Monarca Clinic offers complimentary coordination of ground transportation (airport transfers, hotel-hospital transfers) for patients who request this service. Monarca Clinic does not own or operate any transportation vehicles; transportation is provided by independent third-party providers.

Monarca Clinic can assist with hotel recommendations and booking, but does not own or operate any hotels. Hotel costs are the responsibility of the patient and are not included in procedure quotes unless explicitly stated.

Monarca Clinic does not book, manage, or guarantee international flights. Flight arrangements are the sole responsibility of the patient.

7. Medical Risks and Informed Consent

All surgical and medical procedures carry inherent risks, including but not limited to infection, bleeding, adverse reactions to anesthesia, scarring, unsatisfactory results, and in rare cases, serious injury or death. Complication rates and recovery information provided on this website are based on published medical literature and represent population averages. Your individual risk may differ.

Before any procedure, your surgeon will provide you with a detailed informed consent document specific to your planned procedure. You must read, understand, and sign this document before surgery. The informed consent process is managed entirely by your surgeon and the hospital; Monarca Clinic is not a party to the informed consent.

By engaging Monarca Clinic's services, you acknowledge that you understand that surgery involves risks, that no specific outcome is guaranteed, and that the decision to proceed with surgery is made between you and your surgeon.

 

8. Limitation of Liability

To the fullest extent permitted by applicable law:

• Monarca Clinic is not liable for the medical care, surgical outcomes, complications, injuries, or any other harm arising from procedures performed by independent surgeons in independently operated hospitals.

• Monarca Clinic is not liable for the acts, omissions, negligence, or malpractice of any surgeon, anesthesiologist, nurse, or other medical professional involved in your care.

• Monarca Clinic is not liable for the facilities, equipment, staffing, or quality of care at any partner hospital.

• Monarca Clinic is not liable for any losses, damages, or expenses arising from travel to or from Mexico, including but not limited to flight delays, cancellations, lost luggage, accidents, or illness during travel.

• Monarca Clinic is not liable for any losses arising from currency exchange fluctuations.

Monarca Clinic's total aggregate liability for any claims arising from or related to our coordination services shall not exceed the total coordination fee paid by you for the specific engagement giving rise to the claim.

 

9. Indemnification

You agree to indemnify and hold harmless Monarca Clinic, its founders, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of our website or services; (b) your decision to undergo a medical or surgical procedure coordinated through Monarca Clinic; (c) any violation of these Terms; or (d) any violation of applicable law.

10. Intellectual Property

All content on the Monarca Clinic website, including text, graphics, logos, images, videos, and software, is the property of Monarca Clinic or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.

Surgeon photographs and biographies are used with the permission of the respective surgeons and may not be reproduced without their consent.

11. Testimonials and Reviews

Patient testimonials and reviews displayed on our website represent the individual experiences of those patients. They are not guarantees of specific outcomes. Individual results vary. All testimonials are published with the written consent of the patient.

 

12. Third-Party Links

Our website may contain links to third-party websites, including hospital websites, surgeon profiles on external platforms, and other resources. These links are provided for your convenience and information. Monarca Clinic does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites.

 

13. Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of our website or services after any modification constitutes your acceptance of the updated Terms. If we make material changes, we will notify you by email or through a prominent notice on our website.

 

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

 

15. Entire Agreement

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Monarca Clinic regarding your use of our website and services. They supersede any prior agreements or understandings, whether written or oral.
